Regulation of lobbying in the Czech Republic including a proposal de lege ferenda

Regulation of lobbying in the Czech Republic including a proposal de lege ferenda Transparent lobbying and his regulation is natural and necessary part of functioning of democratic states. Regulation of lobbying done by legislation is supposed to be a fundamental element of transparency of democracies in 21st century; an essential element of an integrated system of development in approximation of civil society and public institutions, mutual trust and transparency in mutual relations. Regulated lobbying should enable citizens of a democratic society to exercise their right to public control of processes associated with the formation of laws, legal norms of lesser legal force and other important decisions. This thesis describes the current situation (March 2016) in the regulation of lobbying in the Czech Republic and choses, by author, suitable alternatives of solution to the lobbying regulation in the future. Due to the fact that lobbying is not regulated or defined by any law in the Czech Republic, lobbying is often pejoratively confused with corruption and generally misunderstood and negatively perceived by the public. Lobbing - economic and legal aspects Abstract This thesis sets to explore lobbying from an economic and juridical standpoint. The main objective is to analyse various methods of regulating lobbying. The analysis is focused on the legal framework for lobbying and its wider implication for the society. It also aims to answer further questions: what lobbying methods are being practiced, who the key players are and what economic and juridical tools are available for the regulation of lobbying. In order to address the last of these questions, it was essential to explore both the latest and historical legal alterations of lobbying. The author also focuses on the juridical and economic consequences derived from the latest lobbying laws and regulation abroad and impacts of the juridical and economic tools that are currently in use. This thesis further explores the current juridical state of lobbying within the Czech Republic and its potential development. All of these materials are analysed in order to identify which methods and tools are ideal to establish the right regulatory conditions for lobbying in the Czech Republic and which methods and tools should be avoided. Protection against bribery and corruption and their prevention

Thesis describes often mixed terms of corruption and lobbying, tries to distinguish them and explain why there is a crucial difference between disruptive corruption and legitime lobbying, which is one of the key stones of modern demorcracy. The first chapter deals with the general term of corruption, its typology and bribery. The second chapter describes corruption criminal offenses in the czech criminal code and divides them into general and special ones. The third chapter deals with the term of lobbying, and the history of lobbying in the United States of America from the begining of lobbying in 19. century described as influencing politicans by powerful and influential individuals using all aviable techniques and corruption, through advancing regulation by the state. The next part of the chapter is dedicated to lobbying and corruption in the Czech Republic. It gives a few examples on which there is possible to demonstrate the level of current legal regulation, which does not allow transparent control of public on decision making of the public officials. The last part of the chapter shows most serious reasons for appearance of corruption in lobbying, which need to be cleared. Possibilities of lobbying regulation in the Czech Republic

The aim of this thesis is to introduce the system of legislative lobbying regulation namely in United States of America and to apply these findings to the Czech Republic environment and to compare U.S. regulation with Czech proposals of lobbying regulation. Structure of this thesis is divided into theoretical and practical parts. Theoretical part is presenting the lobbying history and the first attempts to regulate the lobbying subsequently the main terms and definitions concerning the lobbying and its regulation are introduced. The practical part includes a closer look to the lobbying regulation in the USA mapping the process from history including the main legal documents to its contemporary form. As follows the information about Czech environment and first attempts to regulate lobbying are presented. Subsequently, at the end of practical part I offer a comparison of the USA system of regulation of lobbying and the proposals according to which the Czech lobbying regulation system should formed.
Regulation of lobbying in Canada

The aim of the bachelor thesis is to define lobbying, actors of lobbying and their lobby activities within the frame of theoretical models of regulation of lobbying and subsequently apply these definitions to specific levels of Canadian government arrangement. The main question then is why it should be legislated to regulate lobbying. The structure of the Canadian organization of the State corresponds to two institutional levels. The first chapter is devoted to definitions of lobbying, and its actors. This chapter is the analysis of legal regulations related to lobbying. The second chapter examines the theoretical models of legal frameworks regulating lobbying. The third chapter of the above definition of lobbying is first applied to the Canadian federal level. The fourth and last chapter of the bachelor thesis gets to the very core of the topic, which monitors regulation of lobbying at the provincial level, which has included into its legal framework and consequently leads to a comparison of these legal frameworks regulating the lobbying in Canada.
